New York Opens a Second Regulatory Front Against Prediction Markets

The New York City Council has opened an investigation into the marketing practices of Polymarket, Kalshi, Coinbase and Gemini Titan, adding a consumer-protection case to the jurisdictional dispute already surrounding prediction markets.

The council is examining allegations involving undisclosed influencer promotions, misleading depictions of profitable trades and marketing that may have reached younger users. An investigation does not establish wrongdoing, and the claims have not been adjudicated.

Kalshi separately faces action from New York state over event contracts. The Commodity Futures Trading Commission has intervened to preserve KalshiEX’s continued operation under federal requirements while the state dispute proceeds. That order does not settle whether state gambling or consumer-protection laws apply.

Strategic Assessment

Prediction platforms previously concentrated their defense on federal jurisdiction. That argument may protect the market itself without protecting how it is advertised.

New York City is targeting promotion and customer acquisition rather than contract approval alone. This creates exposure for platforms, affiliated influencers and distribution partners even if federal derivatives registration survives the state challenge.

Established operators with compliance teams may absorb the cost. Smaller competitors could face a harder choice between slowing growth or accepting greater enforcement risk. Influencer-led acquisition also becomes less attractive if platforms must document compensation and substantiate representations about winning trades.

The central risk is regulatory fragmentation. A platform could remain federally authorised while confronting separate local restrictions on advertising, sports-related contracts or access by younger customers.
