Custodia Asks the Supreme Court to Define Access to Federal Payment Rails

Custodia Bank’s dispute over direct access to Federal Reserve payment infrastructure has reached the US Supreme Court, with the Blockchain Association supporting the bank’s petition through an amicus brief.

Custodia applied for a Federal Reserve master account in October 2020. The Federal Reserve Bank of Kansas City denied the application in January 2023, citing concerns connected to Custodia’s crypto-focused business model.

The Wyoming-chartered bank lost in district court and before the Tenth Circuit. A request for rehearing was denied by a 7–3 vote in March 2026. Custodia now asks whether the Monetary Control Act allows regional Reserve Banks to deny services to an otherwise eligible nonmember institution.

The Kansas City Fed is due to respond by 11 September. The Supreme Court has not agreed to hear the case, and the filing does not change Custodia’s present access.

Strategic Assessment

A master account provides direct access to core Federal Reserve payment services. Without one, crypto-focused banks generally depend on correspondent institutions, adding cost and another point where service can be withdrawn.

Custodia and similarly structured institutions benefit if the Court restricts Reserve Bank discretion. Regional Reserve Banks benefit from the existing position because it preserves their ability to reject institutions they consider operationally risky.

Kraken Financial received a limited purpose master account in March, proving that access is possible but not uniform. Kraken’s arrangement also carries restrictions, including no interest on reserves.

The immediate question is procedural: whether the Supreme Court accepts the petition. If it does, the ruling could alter the boundary between state bank charters and federal payment access. If it declines, the lower court decisions remain intact.
