Intelligence Brief
The U.S. Senate has not scheduled floor action on the CLARITY Act, leaving only a handful of legislative days before lawmakers begin the August recess.
Monday’s published agenda includes a procedural vote on a stopgap funding measure but makes no reference to the Digital Asset Market Clarity Act. The Senate’s cloture ledger also shows no filing for the bill, indicating leadership has not yet initiated the formal process needed to advance debate.
Without a cloture petition, the legislation is unlikely to receive a procedural vote before the chamber adjourns unless Senate leaders act quickly.
Strategic Assessment
The narrowing legislative window raises fresh uncertainty around the CLARITY Act’s timeline.
Senate Majority Leader John Thune has previously said he hopes to begin floor consideration, but acknowledged the bill is unlikely to reach final passage before the August recess. Even if debate begins this week, any Senate amendments would require the legislation to return to the House before reaching the President.
For the crypto industry, the delay extends uncertainty around U.S. market structure rules. While bipartisan negotiations continue, the Senate’s calendar is becoming the biggest obstacle to advancing one of the industry’s most closely watched pieces of legislation.
