CLARITY Act Faces Final Senate Window Before August Recess

The U.S. Senate has just two legislative days remaining to advance the CLARITY Act before lawmakers begin the August recess, placing the bill at a critical stage.

Despite months of negotiations and several revisions, the legislation has yet to secure final Senate approval. The bill seeks to establish a comprehensive regulatory framework for digital assets by defining the responsibilities of the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC).

With time running out, lawmakers must decide whether to move the bill forward or postpone consideration until Congress returns from recess.

Strategic Assessment

The shrinking legislative calendar has become the CLARITY Act’s biggest obstacle.

Even if Senate leaders begin floor consideration, procedural requirements and potential amendments could delay final passage beyond this week. Any Senate revisions would also require another vote in the House before the legislation could reach the President’s desk.

For the crypto industry, the next two days are likely to determine whether the U.S. moves closer to long-awaited market structure reform or extends regulatory uncertainty into the next congressional session.
