Illinois and Crypto Groups Seek Six-Month Delay of State Transaction Tax

Illinois officials and two crypto industry groups have jointly asked a state court to delay the state’s new Digital Asset Tax until July 1, 2027.

The levy had been scheduled to begin January 1. It would impose a 0.2% tax on qualifying digital-asset activity involving businesses with more than $100,000 in receipts, including certain transfers, exchanges and custody services.

The Digital Chamber, Illinois Blockchain Association, Illinois Department of Revenue and state attorney general filed an agreed motion in Sangamon County Circuit Court on October 1. A judge must approve the arrangement before the delay takes effect. coindesk.com

The agreement does not settle the underlying lawsuit. Industry groups argue that the tax is unconstitutional, conflicts with federal protections for electronic commerce and could apply multiple times as an asset moves through different intermediaries. Illinois disputes those claims.

A postponement would reduce the immediate compliance burden while the court considers enforceability. Exchanges and custodians would otherwise need to determine which activities fall within the tax, how Illinois customers are identified and whether multiple service providers owe tax on the same transaction.

The joint motion lowers the near-term implementation risk but does not eliminate the tax. Companies should treat July 1 as the operative date only after judicial approval.

The litigation could become a model for challenges to state-level crypto transaction levies. The most consequential ruling will concern whether a digital-asset-specific tax unlawfully discriminates against electronic commerce.
