New York Sues Polymarket in Major State Versus Federal Jurisdiction Test

New York Attorney General Letitia James and Governor Kathy Hochul have sued Polymarket’s U.S. operator, alleging that its sports event contracts constitute unlicensed gambling under state law.

The 33-page petition names QCX LLC, which operates as Polymarket US. New York is seeking to block the platform from operating without a gambling license, recover allegedly unlawful gains, obtain customer restitution and impose financial penalties.

The state also alleges that Polymarket permits participation by people aged 18 to 20, below New York’s minimum age of 21 for mobile sports wagering. Polymarket had not published a detailed response when CoinDesk reported the filing.

Prediction platforms argue that event contracts are federally regulated financial products under the Commodity Exchange Act and the authority of the Commodity Futures Trading Commission. States contend that contracts involving sports and similar events remain subject to gambling laws.

The complaint contains allegations, not judicial findings. Its significance lies in the unresolved boundary between federal derivatives oversight and state control over gambling.

Polymarket’s return to the United States has moved quickly into the same jurisdictional battle confronting Kalshi.

A ruling that permits states to regulate or prohibit federally listed event contracts could fragment the U.S. prediction market. A ruling favoring exclusive federal jurisdiction would sharply limit state gambling regulators.
