CLARITY Act Adds Ethics Rules to Restrict Officials’ Crypto Activities

Intelligence Brief

Senate Republicans have expanded the CLARITY Act by adding ethics provisions designed to limit conflicts of interest among senior U.S. government officials involved in digital asset policymaking.

The revised draft would prohibit the President, Vice President, Members of Congress, federal judges, senior executive officials, and their spouses from issuing or sponsoring digital assets for compensation. It also requires covered officials to divest certain crypto holdings or place them into qualified blind trusts, with penalties reaching up to $250,000 per day for violations.

The changes follow growing political scrutiny over public officials’ involvement in the digital asset industry as lawmakers work to advance comprehensive crypto legislation.

Strategic Assessment

The updated ethics provisions aim to strengthen confidence in the CLARITY Act by pairing market structure reforms with stricter governance standards.

For institutional investors, regulatory clarity extends beyond defining agency oversight. Confidence also depends on whether policymakers are viewed as acting independently of personal financial interests. By tightening ethics requirements, lawmakers are attempting to reduce one of the bill’s most contentious political issues.

The proposal, however, is unlikely to end the debate. Democrats continue to argue that the draft leaves important gaps unresolved, making the final ethics language a key factor as the legislation moves through the Senate.
