Austria Fines Bitpanda €70,000 in First Published MiCA Penalty

Austria’s financial regulator has fined Bitpanda €70,000 for breaches of the EU’s Markets in Crypto-Assets regulation, marking Austria’s first published penalty under MiCA.

The Financial Market Authority said Bitpanda failed to submit a required crypto-asset white paper within the prescribed timeframe. The company also published related marketing material before filing the document.

A separate advertisement lacked mandatory disclosures and required contact information.

The penalty was issued through an expedited procedure and is now final.

Strategic Assessment

MiCA has moved from implementation into enforcement.

The €70,000 penalty is relatively small for a company of Bitpanda’s size, but the precedent matters more than the amount. Regulators are showing that disclosure deadlines and marketing requirements will be enforced, including procedural violations that may previously have attracted less attention.

That raises compliance exposure for exchanges, token issuers and other crypto firms operating across the EU. Marketing teams are particularly exposed because promotional material can itself trigger MiCA requirements.

Bitpanda’s case also gives the market an early indication of how national regulators may police the bloc-wide framework.

Risk Signals

The immediate financial impact on Bitpanda is limited. The larger risk is repetition.

If regulators across Europe begin publishing similar actions, MiCA compliance will become an operational issue rather than primarily a licensing exercise. Firms will need tighter coordination between legal, product and marketing teams before launching or promoting crypto assets.

For the industry, the message is straightforward: MiCA enforcement is no longer theoretical.
