CFTC Opens Federal Rulemaking Lane for Leveraged Retail Crypto

The CFTC on Monday opened an Advanced Notice of Proposed Rulemaking aimed at creating crypto-specific rules for retail commodity transactions involving leverage, margin or financing. CFTC

The notice focuses on Section 2(c)(2)(D) of the Commodity Exchange Act. The Commission is seeking comment on a uniform national regime for these transactions, crypto-specific compliance practices, prevention of abusive trading and a new purpose-built subcategory of designated contract market called a crypto asset market.

The proposed lane would not give the CFTC comprehensive authority over ordinary spot crypto trading. Reuters reported that the framework instead uses the agency’s existing jurisdiction over leveraged retail commodity transactions, a distinction that matters after Congress failed to advance comprehensive market-structure legislation. The CFTC says comments will be due within 60 days of publication in the Federal Register. The ANPRM is an opening step in rulemaking, not a final regulation. CFTC

TOKEN RECON ASSESSMENT

The agency is testing how much market structure it can build with authority it already possesses. A viable federal registration option could reduce dependence on state-by-state licensing for exchanges that offer covered leveraged products, but the statutory boundary around unleveraged spot trading remains. The next hard evidence will be the proposed rule text produced after the comment record develops.
