IRS Expands Staking Safe Harbor for Digital Asset Investment Trusts

The Internal Revenue Service and Treasury Department issued Revenue Procedure 2026-20 on October 6, updating the federal tax safe harbor that allows qualifying investment and grantor trusts to stake digital assets without automatically jeopardizing their tax classification. The guidance clarifies, modifies and supersedes Revenue Procedure 2025-31. The earlier framework opened a route for certain trusts to participate in proof-of-stake networks while remaining within the tax treatment expected of an investment trust.

Revenue Procedure 2026-20 addresses questions that emerged after the 2025 guidance, including which proof-of-stake protocols qualify, use of multiple custodians, slashing protection, operational unstaking, liquidity arrangements and consistent tax treatment of staking rewards. The updated procedure also provides a six-month transition period beginning October 6 for existing trusts to amend governing documents and operational procedures to conform with the revised requirements. Current Federal Tax Developments

The significance extends beyond staking yield. U.S. exchange-traded crypto products and other trust structures have repeatedly faced a structural question: whether participating in network validation changes the tax character of what was designed to be a passive investment vehicle. A workable safe harbor reduces one source of uncertainty, but only for arrangements satisfying its conditions.

TOKEN RECON ASSESSMENT

The practical signal is that staking inside regulated investment structures is moving from theoretical tax risk toward an administrable framework. That does not mean every crypto trust can stake, and it does not eliminate securities, custody or operational questions. It gives eligible structures a clearer tax lane.

The next confirmation will come from product amendments. If existing or proposed investment trusts revise filings to rely on Revenue Procedure 2026-20, the guidance will have moved from tax policy into actual product design.
