House Committee Advances First Comprehensive Federal Crypto-Tax Framework 38–5

The House Ways and Means Committee has approved the Digital Asset Tax Certainty Act by a bipartisan 38–5 vote, sending the amended legislation toward consideration by the full House.

The official committee record confirms that the amendment in the nature of a substitute passed by voice vote before the committee ordered H.R. 10357 favorably reported.

The bill would create simplified treatment for qualifying blockchain-network fees of $10 or less. Paying a small fee in cryptocurrency currently can create a taxable disposition that requires a gain-or-loss calculation.

High-volume users completing more than 5,000 transfers during the previous year would not qualify for the simplified network-fee treatment.

The legislation also addresses stablecoin transactions, wash-sale rules, asset lending, charitable donations, mining, staking and broker-reporting obligations. A proposed voluntary disclosure process would give qualifying taxpayers a route to correct certain past digital-asset reporting failures.

The Joint Committee on Taxation’s technical description explains that the proposal attempts to align digital-asset taxation more closely with existing treatment for conventional financial property while accounting for blockchain-specific activity.

Committee passage is not final enactment. The bill must still pass the House, secure Senate approval and receive the president’s signature.

TOKEN RECON ASSESSMENT

The 38–5 vote shows considerably stronger bipartisan support than the failed Senate market-structure bill received.

Tax legislation may have a clearer path because it addresses practical reporting problems without resolving every dispute over SEC and CFTC jurisdiction.

Watch the full House schedule, the final de minimis threshold, staking-income timing, broker definitions and whether the Senate takes up the proposal before the end of the current Congress.
