New York Permanently Bars Alex Mashinsky From Finance and Secures Conditional $35 Million Settlement

New York Attorney General Letitia James has permanently barred former Celsius CEO Alex Mashinsky from the securities, commodities and cryptocurrency industries.

The settlement provides for up to $35 million in conditional payments. Mashinsky would owe New York $25 million if he fails to forfeit another $10 million to the federal government and an additional $10 million if he does not serve his full federal prison sentence, the settlement terms reported by Decrypt show.

Mashinsky is serving a 12-year sentence after pleading guilty to fraud and was separately ordered to forfeit more than $48 million. He has asked a court to vacate that sentence. New York’s 2023 civil case alleged he misled hundreds of thousands of Celsius customers, including more than 26,000 New Yorkers, about the lender’s risk.

The agreement resolves the state case without replacing federal forfeiture or incarceration. The headline amount is therefore a maximum contingent obligation, not cash already collected for investors.

TOKEN RECON ASSESSMENT

The permanent industry ban closes a remaining civil-enforcement lane around one of crypto lending’s largest failures. Recovery value depends on the federal forfeiture and sentence conditions, so the next meaningful evidence is actual asset collection, not the theoretical $35 million ceiling.
