Baltimore Lawsuits Extend Prediction-Market Risk to Brokerages and Exchanges

Baltimore filed separate lawsuits against Kalshi and Polymarket, alleging that their sports-event contracts constitute unlicensed gambling under Maryland law.

The complaint involving Kalshi also names Coinbase, Robinhood and Webull. Baltimore alleges that their prediction-market integrations distributed or facilitated access to the disputed sports contracts.

The city’s complaints include allegations under local consumer-protection rules and seek court intervention against the defendants’ activities. These remain allegations. No court has determined that the named companies violated Maryland law.

Kalshi operates as a federally regulated designated contract market. Polymarket has pursued a regulated route back into the United States following its earlier settlement with the Commodity Futures Trading Commission. Both companies operate within a wider dispute over whether event contracts are derivatives under exclusive federal jurisdiction or gambling products subject to state and local restrictions.

Strategic Assessment

Baltimore is testing the distribution layer, not only the market operators.

Coinbase, Robinhood and Webull benefit when prediction contracts add trading volume and keep users inside their platforms. The lawsuit argues that distribution also creates responsibility. If that theory succeeds, brokerages may need to review every event-contract category against local gambling laws.

The defendants face different forms of exposure. Kalshi and Polymarket must defend the legality of their products. Distribution partners must determine whether reliance on a federally regulated venue protects them from local claims.

A ruling against the platforms could slow prediction-market integration across mainstream financial apps. A defence victory could strengthen federal pre-emption and encourage wider distribution.

The complaints should not be treated as proof of unlawful conduct. The strategic value lies in the defendant list. Baltimore is attempting to make product access a shared liability.
